Decision in the Deriugina case.
Lausanne (SUI) FIG Office, July 3, 2008: The FIG Appeal Tribunals reduces the sanctions against Ms Irina Deriugina by four years. The FIG Presidential Commission – at its meeting in Cape Town, 21st April 2008 - has sanctioned Ms Irina Deriugina (UKR), Member of the FIG Rhythmic Gymnastics Technical Committee as follows:
- To suspend Ms Deriugina from her function as a member of the RG TC and any other official function within the FIG immediately and until the end of the current cycle (31.12.2008) and to suspend her from any future official function within the FIG until the end of the cycle 2013-2016;
- To exclude Ms Deriugina to participate in any activity of an FIG Committee or Commission with immediate effect and until the end of the cycle 2013-2016;
- To suspend (prevent) Ms Deriugina from participating in any official FIG event (Olympic Games and all other Multisport Games, World Championships, Continental Championships, World Cup Final, World Cup Series and all international competitions organised by the FIG affiliated member federations) as a member of a delegation, valid immediately and until the end of the cycle 2013-2016;
- To cancel (withdraw) Ms Deriugina’s RG judge’s brevet immediately and until the end of the cycle 2013-2016.
Decision
Ms Irina Deriugina has made an appeal to the FIG Appeal Tribunal who – at its meeting 1st July 2008 in Geneva, decided to grant the appeal from Ms. Irina Deriugina only to the extent that the sanctions stop at the end of the cycle 2009-2012. In his reasoning, the Tribunal finds that Ms Irina Deriugina has breached the rules in Article 5, points 1, 4, 5, 7 and 9 in the FIG Code of Discipline. These violations against the Statutes and the Code of Discipline must render a severe sanction. The Tribunal finds however that eight years is too long and has shortened the sanctions by one Olympic Cycle (4 years). Therefore, the sanctions taken by the FIG Presidential Commission – as mentioned above – are confirmed, but shortened until the end of 2012.
Ms Irina Deriugina has the right to make an appeal against the decision of the FIG Appeal Tribunal to the Court of Arbitration for Sports (CAS) in Lausanne within 21 days.
Second violation
Irina Deriugina was in 2000 suspended from all activities of the FIG for a period of one year, which was confirmed by the Court of Arbitration for Sports (CAS) in Lausanne (SUI) in a decision on June 10, 2002. In the reasoning the Panel of the CAS confirmed that Irina Deriugina had made serious judging mistakes, had given unjustified scores, and had intentionally violated the obligations as a judge and the FIG Code of Points.
